Federal Judge Rules in St. John's Favor in Woman's Clinic Lawsuit

A U. S. District Court judge entered an order in favor of St. John's today granting a summary judgment on all the issues brought by the plaintiff physicians of the Woman's Clinic and Orthopedic Surgery Clinic in the suit they filed against St. John's Health System and St. John's Physicians and Clinics.

The order entered by Judge Gary Fenner said the plaintiffs had not provided facts to support the allegations they made that St. John's had violated state or federal antitrust laws. "After reviewing the voluminous exhibits submitted by Woman's Clinic, the Court concludes that no genuine issue of material fact exists as to whether the activities of St. John's violate the Sherman Act antitrust provisions or Missouri state law," Fenner's order said.

St. John's President and CEO Jay Eckersley said he is pleased with today's ruling. "St. John's has acted appropriately in providing services to meet the health care needs of the Ozarks, and we are delighted to see that the court agreed with our actions."

Today's order was a favorable ruling on St. John's request for summary judgment on all four counts of the lawsuit which was filed in May 2001.
